These Terms of Service ("Terms") govern your access to and use of GenXpat's website at genxpat.us, the Moving Abroad Prep Kit, consultation calls, email content, and any other products or services we offer (collectively, the "Services").

By using our Services or purchasing our products, you agree to these Terms. If you don't agree, please don't use the Services.

Eligibility

You must be at least 18 years old to purchase our products or use our Services. By using the Services, you confirm that you are at least 18 and have the legal capacity to enter into a binding contract.

Account Registration

Some Services (including the Moving Abroad Prep Kit) require you to create an account. You agree to:

Provide accurate, complete information when registering

Keep your account credentials confidential

Notify us immediately if you suspect unauthorized access to your account

Take responsibility for activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Purchases and Payment

Prices for our products are listed on the relevant offer pages. All prices are in US dollars unless otherwise specified.

By purchasing a product, you authorize us (and our payment processor) to charge the payment method you provide. You agree to provide accurate and current payment information.

All sales are final. See "Refunds" below.

We may change our prices at any time. Price changes will not affect purchases you've already made.

Lifetime Access

When you purchase the Moving Abroad Prep Kit, you receive "lifetime access," which means access for as long as we offer the product. We make no guarantee that the product will be offered indefinitely. If we discontinue the product, we will provide reasonable notice and, where practical, an opportunity to export your data.

"Lifetime access" applies to the individual purchaser only. It cannot be transferred, sold, or shared with others. See "Restrictions on Use" below.

Refund Policy

Digital products (the Prep Kit and any other downloadable or instant-access products): All sales are final. We do not offer refunds because you receive immediate access to the full product. If the product is not as described or has a technical issue that prevents access, contact us at [email protected] and we will resolve the issue.

Consultation calls and other services: If you must reschedule a consultation call, please give us at least [48] hours' notice. Calls cancelled with less than [48] hours' notice are non-refundable. If we cancel a call, we will reschedule or refund at your choice.

Statutory rights: Nothing in this section affects refund rights you may have under applicable consumer protection laws.

Restrictions on Use

You agree NOT to:

Share your account credentials, magic links, or product access with anyone else

Copy, reproduce, distribute, resell, sublicense, or publicly display our products or content

Reverse engineer, decompile, or attempt to extract the source code of our Services

Use our Services for any illegal or unauthorized purpose

Interfere with or disrupt our Services (denial of service attacks, scraping at unreasonable volumes, security probes without authorization)

Use our Services to harass, defame, or harm others

Misrepresent yourself or your identity

Sharing your account access with non-purchasers is a material breach of these Terms and may result in immediate termination of your access without refund.

We use various measures (including license watermarking, access tokens, and usage monitoring) to detect and respond to unauthorized sharing.

Intellectual Property

All content provided through our Services - including the Moving Abroad Prep Kit, guides, written content, video content, graphics, templates, and software - is owned by GenXpat or our licensors and protected by US and international intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal, non-commercial purposes. This license does not grant you any ownership rights.

You retain ownership of the information you enter into our planning tools (your personal planning data). We don't claim rights to your data.

If you book a consultation call with us, you understand that:

Calls are educational conversations, not professional services rendered by licensed professionals (unless the specific call is explicitly advertised as legal, financial, or medical consulting by a credentialed provider)

We will not give legal, financial, medical, or other professional advice during calls

Recordings, if made, are for our internal training purposes unless we explicitly state otherwise

We don't warrant that our Services will be uninterrupted, error-free, or completely secure. We don't guarantee any specific outcome from using our Services (you may or may not successfully move abroad, save money, find the right city, etc. - that depends on factors outside our control).

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GENXPAT AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.

Some jurisdictions don't allow these limitations, so they may not apply to you in full.

Indemnification

You agree to indemnify and hold harmless GenXpat and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any third party's rights.

Termination

You may stop using our Services at any time.

We may suspend or terminate your access if:

We're required to by law

We discontinue the Services (with reasonable notice where possible)

We have reasonable grounds to believe you've engaged in fraud or abuse

Termination doesn't entitle you to a refund of fees already paid, except where required by law.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute arising from these Terms or our Services will be resolved in the state or federal courts located in Miami Dade, Florida. You consent to the jurisdiction of those courts.

Any dispute that cannot be resolved through good-faith negotiation will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration held in Florida. You waive any right to a jury trial or to participate in a class action.

Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent changes. We will notify you of material changes by email or via a notice on the website. Continued use of our Services after changes take effect means you accept the updated Terms.

Miscellaneous

If any part of these Terms is found unenforceable, the rest remain in effect.

Our failure to enforce any provision doesn't waive our right to enforce it later.

These Terms (together with our Privacy Policy and any other policies referenced here) are the entire agreement between you and GenXpat regarding your use of our Services.

You may not assign or transfer your rights under these Terms. We may assign our rights as part of a merger, acquisition, or sale of assets.
